1. Mapnetik Services

Mapnetik provides done-for-you local online presence management services for businesses. Depending on the services provided to you, these may include management and optimization of Google Business Profiles, local search visibility, business listings and citations, reviews and reputation, business content and updates, local search optimization, AI search visibility, monitoring, reporting, and related services.

Specific features may change or evolve as search engines, directories, artificial intelligence platforms, technology providers, and other third-party services change.

2. Eligibility

You must be at least 18 years old and legally capable of entering into an agreement to purchase or use Mapnetik services.

If you purchase services on behalf of a business or other organization, you represent that you have authority to enter into these Terms on behalf of that organization.

3. Customer Responsibilities

To provide our services, Mapnetik may require access to or authorization for certain business accounts, profiles, listings, websites, or other online properties.

You agree to provide accurate and current business information and any permissions reasonably required for us to perform the services.

You are responsible for ensuring that information you provide to Mapnetik is accurate and that you have the right to provide or authorize the use of that information.

You remain responsible for your business operations, products, services, pricing, customer relationships, regulatory requirements, and the accuracy of information about your business.

4. Third-Party Platforms

Mapnetik's services may involve or depend upon third-party platforms and services, including search engines, maps, directories, review platforms, artificial intelligence services, communications providers, analytics providers, and other technology services.

Mapnetik does not own or control these third-party platforms.

Third-party platforms may change their algorithms, policies, features, pricing, eligibility requirements, ranking systems, APIs, or availability at any time.

Mapnetik is not responsible for interruptions, suspensions, changes, ranking fluctuations, account actions, or other events caused by third-party platforms that are outside Mapnetik's reasonable control.

5. Google Business Profile and Other Business Listings

When Mapnetik manages or assists with a Google Business Profile or another business listing, the customer remains responsible for complying with the applicable platform's policies and guidelines.

Mapnetik may make recommendations or changes intended to improve the completeness, accuracy, visibility, and performance of business profiles and listings.

Google and other third-party platforms ultimately determine how businesses appear, rank, and are displayed within their services.

6. No Ranking or Results Guarantee

Mapnetik works to improve and manage your local online presence, but we do not guarantee any specific ranking, placement, number of leads, number of calls, number of customers, revenue increase, review volume, search traffic, or other business result.

Search rankings and online visibility can be affected by numerous factors outside Mapnetik's control, including competition, location, search algorithms, market conditions, customer behavior, business history, reviews, and changes made by third-party platforms.

Examples, case studies, demonstrations, ranking reports, screenshots, or previous results shown on our website or in our marketing materials are illustrative and do not guarantee that another business will achieve the same results.

7. Fees and Billing

Mapnetik's standard service is currently offered at $495 per month, unless a different price or service arrangement is agreed to in writing.

By purchasing a recurring Mapnetik service, you authorize us or our payment processor to charge your selected payment method for applicable recurring fees.

Recurring charges will continue according to the billing arrangement presented when you purchase the service until the service is canceled.

You are responsible for maintaining a valid payment method and accurate billing information.

Applicable taxes may be added where required by law.

8. Cancellation

Unless otherwise stated in a separate written agreement or at the time of purchase, Mapnetik services are provided on a month-to-month basis.

You may cancel your recurring service by contacting Mapnetik using the contact information provided below.

Cancellation prevents future recurring charges after the cancellation becomes effective. Amounts already charged for a current billing period are not automatically prorated or refunded except where required by law or expressly agreed to by Mapnetik.

Upon termination or cancellation, Mapnetik may discontinue ongoing management, monitoring, reporting, content creation, communications, and other services associated with your account.

9. Refunds

Except where required by applicable law or otherwise expressly stated in writing, payments for services already provided or for a billing period that has already begun are non-refundable.

If you believe you were charged incorrectly, contact Mapnetik so we can review the issue.

10. Reviews and Reputation Management

Mapnetik may provide tools or services intended to help businesses request, monitor, manage, or respond to customer reviews.

Customers must not use Mapnetik services to create fake reviews, purchase reviews, misrepresent customer experiences, or otherwise violate the policies of review platforms or applicable law.

Mapnetik does not control whether customers leave reviews, what those reviews say, or whether a third-party platform publishes, removes, filters, or modifies a review.

11. Communications

By providing your contact information, you agree that Mapnetik may communicate with you regarding inquiries, audits, appointments, your account, and services you have requested.

If you separately consent to marketing communications, Mapnetik may also send promotional emails or text messages in accordance with applicable law and your communication preferences.

Message and data rates may apply to SMS communications. Message frequency may vary. You may opt out of marketing text messages by replying STOP and may unsubscribe from marketing emails using the unsubscribe link provided in those emails.

Consent to receive marketing communications is not a condition of purchasing Mapnetik services.

12. Intellectual Property

The Mapnetik name, branding, website design, graphics, text, and other materials created or owned by Mapnetik are protected by applicable intellectual property laws and may not be copied, reproduced, distributed, or used without permission.

Customers retain ownership of their own trademarks, logos, business information, photographs, and other materials they provide to Mapnetik.

By providing materials to Mapnetik, you grant us permission to use those materials as reasonably necessary to provide the requested services.

13. Acceptable Use

You may not use Mapnetik services for unlawful, fraudulent, deceptive, abusive, or malicious purposes.

You may not attempt to interfere with the operation or security of our website, systems, services, or third-party platforms used in connection with our services.

14. Suspension or Termination

Mapnetik may suspend or terminate services if a customer fails to make required payments, violates these Terms, uses the services unlawfully, abuses our systems or personnel, or creates a material risk to Mapnetik or its service providers.

Where reasonably practical, we may provide notice and an opportunity to resolve the issue before terminating services.

15. Disclaimer of Warranties

To the extent permitted by applicable law, Mapnetik's website and services are provided on an “as is” and “as available” basis.

We do not warrant that our website or services will be uninterrupted, error-free, or compatible with every third-party platform, nor do we warrant any particular search ranking or business outcome.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

16. Limitation of Liability

To the extent permitted by applicable law, Mapnetik will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business opportunities, lost data, or losses resulting from third-party platforms or services.

To the extent permitted by applicable law, Mapnetik's total liability arising from or relating to the services will not exceed the amount paid by the customer to Mapnetik for the services giving rise to the claim during the three months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold Mapnetik harmless from third-party claims, damages, liabilities, or expenses arising from information or materials you provide, your business activities, your violation of applicable law or third-party platform policies, or your material breach of these Terms.

18. Changes to Services or Terms

We may update our services or these Terms from time to time.

If we make material changes to these Terms, we will post the updated Terms on this page and update the “Last Updated” date.

Your continued use of the services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

19. Governing Law

These Terms will be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except where applicable law requires otherwise.

20. Entire Agreement

These Terms, together with any applicable order, service agreement, Privacy Policy, or other written agreement between you and Mapnetik, constitute the agreement governing your use of the applicable Mapnetik services.
